General Terms and Conditions of Sale

Article 1 – Purpose and scope

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between:

The customer: any professional, researcher or member of a research entity placing an order for research purposes on the peptiniumlabs.com website.

The website offers chemical products and reagents intended exclusively for scientific laboratory research (in vitro use only). Any order implies unreserved acceptance of these GTC.

Article 2 – Products – Strictly restricted use

The products sold are strictly intended for laboratory research use (Research Use Only – RUO). They are neither medicinal products, nor food supplements, nor products intended for veterinary, diagnostic or therapeutic use.

The customer declares and warrants that the products are used exclusively for research, studies or laboratory analyses, whether on their own behalf or on behalf of a company, research organisation or academic institution.

The seller declines all liability in the event of any use other than the one expressly provided for (in vitro research), and in particular in the event of administration to animals or of therapeutic, cosmetic or food use.

Article 3 – Orders and acceptance

The customer declares having read and accepted these GTC before validating their order.

Any order is firm and final upon payment validation. The seller reserves the right to refuse any order if there is any doubt about the actual use that will be made of the products.

Acceptance of the GTC is evidenced by ticking the box “I accept the general terms and conditions of sale” before payment validation.

Article 4 – Prices and payment

Prices are shown in euros, all taxes included. VAT is not applicable – small-business exemption (article 293 B of the French Tax Code).

Payment is due immediately upon ordering and is made using the payment methods offered on the website.

Article 5 – Delivery

Products are shipped in neutral, discreet packaging, with no mention of the contents on the outside of the parcel.

Delivery times are given for information only. The customer is solely responsible for compliance with local regulations applicable to the import and use of the products.

Article 6 – Right of withdrawal

In accordance with article L.221-18 of the French Consumer Code, the customer has a 14-day right of withdrawal from receipt of the products.

However, in accordance with article L.221-28 of the French Consumer Code, this right cannot be exercised for products that have been opened, reconstituted or whose sealed packaging has been altered after delivery, for safety and health protection reasons. Consequently, no return or refund will be accepted for any product whose sealed packaging has been opened.

Article 7 – Warranty and liability

Products are sold as is, without any warranty of fitness for a specific use. The seller may under no circumstances be held liable for the use made of the products by the customer.

The customer assumes full responsibility for the use they make of the products, including in the event of misuse, handling error or use not compliant with their intended purpose (in vitro research).

Article 8 – Strictly restricted use – Customer undertaking

The customer expressly undertakes to use the products only within the framework of scientific laboratory research.

Any animal, therapeutic, diagnostic, cosmetic or other use is strictly prohibited and falls under the sole responsibility of the customer.

The seller reserves the right to refuse any order if there is any doubt about the actual use that will be made of the products.

Article 9 – Personal data

Collected data is processed in accordance with the GDPR. It is used solely for order processing and customer relations.

The customer has a right of access, rectification and objection, which may be exercised by email at the address indicated on the website.

Article 10 – Evidence and archiving of contracts

Ticking the box “I accept the general terms and conditions of sale” before payment validation constitutes irrevocable and unreserved acceptance of these terms.

Contracts are archived by the seller. In accordance with applicable regulations, the customer may access their invoices from their customer account.

Article 11 – Governing law and jurisdiction

These GTC are governed by French law.

In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, the French courts shall have sole jurisdiction.
